definition of processing

In the judicial sphere, there are different and varied instances in which the corresponding authorities act to carry out a legal process. One of these instances, one of the most important, is the processing instance. We understand by processing the moment in which a person or entity becomes compromised with regard to the resolution of a crime. In this sense, it is important to point out that the person who is prosecuted is not accused at that time of guilt, but rather it is considered that they may have some fairly direct and clear relationship with the crime committed. The instance in which it is determined whether that person or entity is effectively guilty or not, in addition to determining its possible acquittal or punishment, is the trial, higher and next instance to the prosecution.

Justice has its means and methods to resolve conflict situations, as well as to clarify crimes or crimes. In any of the cases, when a person is accused of a crime or crime, the first thing that prosecutors and investigators must do is precisely carry out an investigation that allows them to obtain and analyze useful evidence for the case. In this first stage, one begins to determine or delineate the type of crime, the suspect (s) (who are not yet understood as guilty since there is no legal certainty about it), the motive for the crime, etc. The investigation process can be very long depending on the amount of evidence or the lack of it.

When this process is finished, those responsible for having carried it out raise to the corresponding court their presumption of suspicion about any person or entity. It is the judge or the court composed of three judges who must decide after the analysis of the information whether the person is dismissed (that is, freed from all presumption of guilt due to lack of merit) or if he is prosecuted, in which case we will be talking about a more obvious and direct relationship with the crime committed. Although the act of prosecuting a person does not directly imply guilt, it does mean that the person or entity in question could not be immediately separated from the act. In some cases, the processed person can be detained preventively if his freedom is considered as a danger for the resolution of the case.
